Please read these terms and conditions (“Terms”) carefully. By submitting an application for Perry, the Birmingham 2022 Commonwealth Games mascot, (“Perry”) to visit your school, you are:

  • agreeing to be legally bound by these Terms on behalf of both yourself and the school included in the Application; and
  • confirming that you have the permission of your school to accept these Terms and request a visit from Perry on its behalf.

  1. The Birmingham Organising Committee for the 2022 Commonwealth Games Ltd is referred to in these Terms as “Birmingham 2022” or “we” (or “us” or “our” depending on the context).
  2. Birmingham 2022 is arranging for Perry to visit selected local schools that have previously expressed an interest in a visit. As we expect demand for Perry to be high, we have set up an application process, through which local schools can request a visit from Perry.
  3. If you want to request that Perry visit your school, then you must submit an application (“Application”), using the form available on our website between 17:00 on Friday 3rd September 2021 and 23:59 on Sunday 31st October 2021 (the “Application Period”). We are currently planning to manage applications for visits from Perry on a term by term basis, so there may be future application periods, at our option.
  4. To make an Application, you (as the “Applicant”) must:
    • (a) be an authorised representative, aged over eighteen (18); of
    • (b) a school (“Qualifying School”) providing primary, secondary and/or special education from school buildings in any of the following post codes in the West Midlands:

  5. All Applicants must be authorised by the school they include in the Application to accept these Terms (and to request a visit from Perry), on their own behalf and on behalf of the Qualifying School. Birmingham 2022 reserves the right to verify the eligibility of any Applicant, their authority to make an Application on behalf of a Qualifying School and/or the Qualifying School’s acceptance of these Terms.
  6. Internet access is required to submit an Application.
  7. To submit an Application, you will need to:
  8. On the Application form, you will need to provide the following information:
    • (a) your name, role at the school, contact number and email address (as the authorised representative of the school submitting the Application);
    • (b) the name of the school you represent;
    • (c) the postcode of the school;
    • (d) the type of school: (i.e Primary, Secondary, Special Education);
    • (e) the type of visit: (i.e Assembly, Sports Day);
    • (f) the preferred month of visit (selecting from the drop down menu);
    • (g) your secondary preference for the month of visit (selecting from the drop down menu);
    • (h) any other information you think we should know regarding the visit (please note that this is intended to cover e.g. additional details regarding the nature of the event (that are not included in the drop down menu)- for example, if the event is end of term awards ceremony or if your assembly/event has a specific theme – what you include in this part of the form will not play any part in whether your school is successful in its application for a visit from Perry).
  9. Contact details provided and other information submitted or reviewed by Birmingham 2022 in connection with the Application will be used in accordance with our Privacy Notice.
  10. Please note that if we are not able to contact the Applicant (because we do not have contact information or the contact information is not correct), then we reserve the right to exclude the Application from the process.
  11. Each Applicant and each Qualifying School is entitled to submit only one Application for a visit from Perry. Qualifying Schools may not submit multiple Applications through different Applicants.
  12. Birmingham 2022 reserves the right to exclude from the process:
    • (a) late or incomplete Applications;
    • (b) Applications where Birmingham 2022 knows or suspects that the Applicant does not have authority to submit the Application and accept these Terms on behalf of the Qualifying School;
    • (c) duplicate Applications submitted on behalf of the same Qualifying School;
    • (d) Applications submitted in breach of these Terms or by a person or school which is not eligible under these Terms.

    Birmingham 2022 cannot take any responsibility for Applications that are lost, mislaid, damaged or delayed in transit, incomplete, unreadable or unable to be viewed, regardless of the cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware, software or website failure of any kind.

  13. We want Perry to visit as many schools in the West Midlands as reasonably possible but there are limited time and date slots available. Successful Qualifying Schools will be eligible to receive a visit from Perry on a date and at a time to be specified by Birmingham 2022. Please note that we will have regard to the preferences for time and date included on the Application, if and to the extent that we are able to do so in light of Perry’s schedule – however, we cannot guarantee that the visit from Perry will at the preferred time or on the preferred date(s).
  14. We will aim to notify successful Qualifying Schools by email using the contact details provided on the Application (the “Notification”) on or before Friday 17th December 2021. The successful Qualifying Schools must, within two weeks: (or such other date as we may agree):
    • (a) confirm their acceptance of these Terms in writing;
    • (b) confirm that they are happy to receive a visit from Perry on the date and at the time proposed by Birmingham 2022;
    • (c) provide such other documentation as Birmingham 2022 may reasonably request in connection with the visit from Perry;
    • (d) sign any additional documentation that may be required in connection with the visit from Perry, such as, but not limited to, an event sheet/booking form (outlining, for example, changing facilities, hazards, precise location within the school), declarations for security, health and safety, confidentiality, consent forms or publicity releases;
    • (e) if requested by us (and subject to applicable laws and appropriate consents in relation to the photographing or filming of identifiable individuals), agree to the visit being photographed and/or filmed in order to create content which may be used on the Birmingham 2022 promotional materials, which may include (but is not limited to) the Birmingham 2022 website and social media channels.

    If any Qualifying School does not comply with their obligations in this section, then Birmingham 2022 reserves the right to select a replacement Qualifying School for the visit.

  15. Birmingham 2022 is not responsible for any delay or failure to receive the Notification for any reason, including inactive or incorrect telephone details. It is the Applicant’s responsibility to provide accurate contact details and check messages.
  16. We will aim to let Qualifying Schools know whether or not they have been successful in their Application by Friday 3rd September 2021.
  17. If an Applicant is unable to be contacted after reasonable attempts have been made to do so, and/or the Qualifying School is unable to accept a visit from Perry on the scheduled date, and/or the Applicant or the Qualifying School is found to be in breach of the Terms and/or does not provide the required documentation in accordance with these Terms, then Birmingham 2022 reserves the right to offer the relevant visit to another Qualifying School.
  18. Visits from Perry will take place at the Qualifying School specified in the successful Application, at the time and on the date specified by Birmingham 2022. The length of Perry’s visit will be discussed with the successful Qualifying School on scheduling the visit but will be subject to Perry’s availability on the relevant day.
  19. Please note, in connection with any visit from Perry, that Perry will not be able to:
    • Speak in costume
    • Perform or participate in any Question and Answer sessions
    • Perform any dancing solo or as a dance crew
    • Walk down steep staircases
    • Pick up or hold small babies or children
    • Pat or approach animals
    • Hold any items unless requested to directly by Birmingham 2022’s ‘Mascot Co-ordinator’
    • Be photographed next to any commercial logos other than Birmingham 2022 Commonwealth games sponsors
    • Appear to endorse any product, brand or service or appear in branded apparel
    • Appear with other costume characters that are sponsored external to the Birmingham 2022 Commonwealth Games sponsor family
    • Walk through muddy fields or appear in the rain
    • Do anything that could damage the mascot suit
    • Be asked to perform any actions that could cause damage or embarrassment
  20. Successful Qualifying Schools must provide at least 72 hours’ notice of cancellation. There is no guarantee that a cancelled visit can be rescheduled.
  21. Any decision of Birmingham 2022 as to eligibility to submit an Application or to take part in the process, or as to the successful Qualifying Schools, will be final and no correspondence will be entered into.
  22. Birmingham 2022 reserves the right to delay, postpone or cancel the Application Period and/or any visit from Perry in the event of circumstances outside its reasonable control, which it considers make it necessary for it to do so. If a visit from Perry is cancelled by us, then we will use reasonable endeavours to reschedule it on another appropriate date.
  23. Any personal information supplied in connection with any Application will be used, shared and retained as set out in the Privacy Notice of Birmingham 2022.
  24. These Terms and any issues, disputes or claims arising out of or in connection with them (whether contractual or non-contractual in nature) are governed by the laws of England and Wales. Birmingham 2022, Applicants and Qualifying Schools submit to the exclusive jurisdiction of the courts of England and Wales.
